AGRICULTURAL TOURISM WARNING, TERMS & CONDITIONS, AND PARTICIPANT ACKNOWLEDGMENT

BY SIGNING BELOW, I ACKNOWLEDGE THAT I HAVE READ, UNDERSTAND, AND AGREE TO THESE TERMS & CONDITIONS, INCLUDING THE AGRICULTURAL TOURISM WARNING REQUIRED UNDER WISCONSIN LAW. I UNDERSTAND THAT MY ELECTRONIC SIGNATURE IS LEGALLY BINDING AND HAS THE SAME FORCE AND EFFECT AS A HANDWRITTEN SIGNATURE.

"A person who observes or participates in an agricultural tourism activity on this property assumes the risks inherent in the agricultural tourism activity. Risks inherent in the agricultural tourism activity may include conditions on the land, the unpredictable behavior of farm animals, the ordinary dangers associated with equipment used in farming operations, and the potential that a participant in the agricultural tourism activity may act in a negligent way that may contribute to injury or death. The agricultural tourism provider is not liable for the injury or death of a person involved in an agricultural tourism activity resulting from those inherent risks."

I acknowledge that participation in activities at Schmalz Acres Adventure Zone and Sprangers Orchard is voluntary and that I agree to follow all posted rules, instructions, and safety requirements.

If I am purchasing tickets, making reservations, or registering participants on behalf of other individuals, I represent and warrant that I have the authority to do so and that I have communicated, or will communicate, these Terms & Conditions and the Agricultural Tourism Warning to all participants included in my reservation. I further acknowledge that all participants assume the inherent risks associated with agricultural tourism activities as described above.

If I am purchasing tickets or registering a participant under the age of 18, I represent that I am the participant's parent, legal guardian, or otherwise authorized to act on the participant's behalf and to accept these Terms & Conditions for that participant.

This agricultural tourism activity is provided by Schmalz Custom Landscaping, Inc., operating as Schmalz Acres Adventure Zone and Sprangers Orchard.
